Rules for uploading and use by Users of training materials on the OHI-S platform

Introduction

Thank you for using the OHI-S platform and its related products, services and features (collectively, the “Service”).

Service

The service is a platform at the link https://ohi-s.com/, and at the same links with territorial subdomains (https://ru.ohi-s.com/, https://es.ohi-s.com / etc.), where users can find and watch videos and other content, publish their own materials (articles and videos), as well as communicate with each other and share news and ideas. The platform also provides authors and advertisers with the opportunity to show and distribute videos, articles, advertisements and other content.

Service Provider

The service provider of the Service is OHI-S MEDICAL TECHNOLOGY - FZCO (hereinafter referred to as OHI-S or “we”), which operates in accordance with the laws of the United Arab Emirates. The company is registered at Dubai Silicon Oasis, DDP, Building A2-101, Dubai, United Arab Emirates.

Applicable terms and conditions

Use of the Service is subject to these terms and conditions, as well as other rules and regulations related to the Service, which are posted on the website https://ohi-s.com/. Collectively, these rules are referred to as the “Agreement.”

We ask you to carefully read the Agreement. If you do not understand or accept any part of it, you may not use the Service.

Who can use the Service?

Age restrictions

The Service may only be used by persons over 18 years of age, however, if permitted by a parent or guardian, children of any age may use the Service

Parent or guardian permission

If you are under 18 years of age, you must not use the Service without parental or guardian consent. Ask them to read this Agreement with you.

If you are the parent or guardian of a user under 18 years of age, then by allowing your child to use the Service, you agree to comply with the terms of the Agreement and be responsible for the actions that your child takes on the Service.

Companies

If you use the Service on behalf of a legal entity or individual entrepreneur, you confirm that you have the authority to act on behalf of this legal entity or individual entrepreneur and that this legal entity or individual entrepreneur accepts the terms of the Agreement.

Use of the Service

Service Content

The Content of the Service includes videos, graphics, photographs, articles, text (for example, comments and texts of videos, texts of articles), branding elements (including trade names, trademarks, service marks and logos), interactive features, software, metrics and other materials provided by you or third parties (collectively, “Content”). Responsibility for the Content lies with the individual or legal entity that uploaded it to the Service. If you find that the Content does not comply with this Agreement, you may notify us by email at info@ohi-s.com.

Service Accounts

You can use some functions of the Service without a Service account. However, to access more features, a Service account is required. To ensure the protection of your Service account, do not share your password with anyone or reuse it in third-party applications.

Your information

Information about how we collect and process your personal data, as well as ensure its security when you use the Service, is provided in our Privacy Policy at https://ohi-s.com/confidentiality/?tab=learning and at the same links with territorial subdomains (https://ru.ohi-s.com/confidentiality/?tab=learning, https://es.ohi-s.com/confidentiality/?tab=learning, etc.)

Permissions and restrictions

You may access and use the Service provided that you comply with the law and this Agreement. Use of the Content is permitted only for personal, non-commercial purposes.

To use the Service, you must comply with the specified restrictions. Do not do the following:

1. Copy, download, distribute, transmit, broadcast, display, sell, license, modify, transform or in any way exploit the Content or any part of the Service, except as provided below. To perform these actions, the following is required: a) permission by the rules of the Service; b) prior written permission from representatives of OHI-S and, if necessary, the relevant copyright holders; c) permission in accordance with applicable law.

2. Do (or attempt to do) any of the following: circumvent, disable, defraud, or otherwise interfere with the operation of the Service, including security-related features or features that: a) prevent or restrict use or copying any Content; b) impose restrictions on the use of the Service or Content.

3. Use the Service through automated means, such as bots, botnets, and content scrapers. Exceptions: a) bots of public search networks; b) prior written permission from OHI-S; c) applicable legislation allowing such actions.

4. Collect any information that could be used to personally identify you, such as user names or their faces. Such actions can be performed only with the permission of this person or in the cases specified in the previous paragraph 3.

5. Use the Service to distribute unsolicited advertising or commercial materials and other unwanted, intrusive materials (spam).

6. Baselessly accuse other users: submit false complaints, mark content as inappropriate, file copyright complaints, as well as appeals and objections.

7. Use the Service to reproduce Content for any purpose other than personal and non-commercial.

8. Use the Service (a) to sell any advertising, sponsorship or promotions placed through the Service or through the Content; b) to sell advertising, sponsorship or promotions on a page of any site or application where only Service Content is contained, or where it is the primary content (for example, selling advertising on a page where OHI-S videos are the only valuable content).

Reservation of rights

Any rights not expressly granted to you in this Agreement are reserved by OHI-S or their respective rights holders. Thus, use of the Service, for example, does not give you intellectual rights to the Content you access, including any customization used or displayed on the Service.

Changes, improvements and updates to the Service

We are constantly working to improve our platform. As part of this process, we may make changes to the operation of the Service or certain parts of it, for example, adding or removing features and functionality, as well as introducing new digital content and services and discontinuing existing ones. In addition, we may make changes to or discontinue the Service. Updates may be aimed at improving the functioning or increasing the security of the platform. Innovations are also being introduced to comply with legislation, prevent illegal activities and protect the system from intruders. These changes may affect all users, certain groups of users, or even individuals. If we make material changes that adversely affect your use of the Service, we will notify you in advance. The exception is in situations where there is an urgent need to suppress violations, comply with legal requirements, or resolve security or functionality issues.

Your Content and Behavior

Uploading Content

If you have an OHI-S account, you may upload Content to the Service. All Content you upload must comply with the Agreement and the law. For example, Your Content must not contain third party intellectual property unless You have the appropriate person's permission or other legal basis. You are legally responsible for all Content you add to the platform.

Rights you grant

You retain all rights to your Content. However, you agree to grant the rights below to OHI-S and other users of the Service.

Rights granted by OHI-S

By uploading Content to the platform, you grant OHI-S a non-exclusive, transferable, royalty-free license to use Your Content throughout the world, with the right to sublicense. OHI-S receives, among other things, the right to reproduce, distribute, modify and display Your Content for the development, operation and improvement of the Service.

Rights granted to other users

You grant each user of the Service a non-exclusive, royalty-free, worldwide license to access and use Your Content to the extent permitted by the functionality of the Service (including the right to reproduce, distribute, modify, display and demonstrate it).

License validity period

The rights to use Your Content continue until it is removed as described below. Once it is removed, licenses terminate unless otherwise required to operate the Service, use the Content in accordance with the permissions granted prior to removal, or as required by law. If you delete Content, OHI-S is not obligated to also delete: a) copies stored by users for offline viewing; b) copies, the storage of which is due to legal purposes.

Right to monetization

You grant OHI-S the right to monetize Your Content on the Service, including by displaying advertisements within the Content or charging users for access to it. This Agreement does not give you the right to receive any payments.

Removal of Content on your part

You may delete your Content at any time. You may also make a copy of Content before deleting it. Please note that you will be required to remove Content if you lose the rights required under these Terms.

Removal of Content by OHI-S

If we have reason to believe that your Content: 1) violates the terms of this Agreement; or 2) may harm the OHI-S platform, its users or third parties, then we reserve the right to remove the entire Content or its individual fragments. In this case, you will receive a notice explaining the reason for the removal unless doing so would: (a) violate the law or a law enforcement order or subject OHI-S to legal liability; b) jeopardize the full functioning of the Service or the progress of the investigation; c) harm any user, third party, OHI-S.

Community Guidelines Warnings

OHI-S has a warning system in place for Content that violates the Agreement. For each subsequent violation, we issue warnings, which entail certain restrictions. We can also delete your OHI-S account without the possibility of recovery. If you believe that the warning was issued to you in error, you can file an appeal by email at info@ohi-s.com.

If any features in your account are disabled due to a warning, you cannot use them in your other accounts. If you attempt to circumvent the restriction, it will be a violation of this Agreement. In such cases, OHI-S reserves the right to terminate your OHI-S Account and block access to all or some features of the Service.

Copyright protection

If you believe that your copyright has been violated in the Service, please notify us by email at info@ohi-s.com.

We review reports of alleged copyright infringement and act in accordance with the Agreement. You can also learn from this resource what to do if you receive a copyright infringement notice. Please remember that if you repeatedly violate copyright, we block the user's access to the Service.

Temporary blocking and deletion of account

Deleting an account on your part

You may stop using the Service at any time. In this case, you have the opportunity to first download a copy of your data and then delete your OHI-S account. All your information and OHI-S account will be deleted.

Blocking and deleting an account by OHI-S

OHI-S reserves the right to temporarily or permanently block your OHI-S account, access to the entire Service or to its individual sections, if: a) you have materially or repeatedly violated this Agreement; b) such measures are required from us by law or court decision; c) We have reason to believe that your actions may create legal liability or harm to any user, third party and/or OHI-S.

Notification of removal or blocking

You will receive a notice explaining the reason for the removal or blocking, except in situations where doing so would: (a) violate the law or a law enforcement order; b) jeopardize the progress of the investigation; c) compromise the functionality or security of the Service; d) harm any user, third party and/or OHI-S.

Consequences of blocking or deleting an account

Even if your OHI-S account is deleted or access to the Service through it is limited, you can still use some functions, for example, watch some videos and articles without authorization. In this case, the terms of this Agreement remain. If you believe that your account was blocked or deleted by mistake, you can submit an appeal by email at info@ohi-s.com.

Other legal conditions

Guarantees

When providing the Service, we act with due care and professional competence.

Exclusion of Warranties

The terms of this Agreement do not affect your rights provided by law, which cannot be excluded or modified by contract. Nothing in this agreement affects the rights you have as a consumer. Except as otherwise stated in this Agreement or required by law, OHI-S makes no warranties, representations or promises with respect to the Service. In particular, we make no warranties, representations or promises regarding the Content on the Service; specific functions and properties of the Service; as well as its accuracy, reliability, availability and suitability to your needs. In addition, we do not guarantee that Content you upload to the Service will be accessible or stored on the Service.

Disclaimer

For all users: Nothing in this Agreement excludes or limits the parties' liability for death, personal injury, fraud or fraudulent misrepresentation, or liability that cannot be excluded or limited by law.

To the extent permitted by applicable law, OHI-S is not responsible for the following:

1. losses that you suffered not as a result of violation of the terms of the Agreement by OHI-S;

2. Losses that, at the time of entering into the Agreement with OHI-S, were not a reasonably foreseeable consequence of a violation of the terms of the Agreement by OHI-S;

3. Content posted by any users or for their defamatory, offensive or illegal actions.

Links to third party sites

The Service may contain links to third-party websites and online services that are not owned or controlled by OHI-S. OHI-S is not responsible for such sites and online services. Follow links to third-party sites and online services with caution. We recommend that you read their terms of use and privacy policy when making the switch.

About this Agreement

Change of Agreement

We may change the terms of this Agreement, including: 1) to reflect updates to the Service, such as when we add new products and features or discontinue support for existing ones; 2) for legal or regulatory reasons or for security reasons; 3) to prevent disruption or damage.

We will notify you in advance of significant changes and give you an opportunity to review them in advance, except in the following cases: 1) the launch of a new product or feature; 2) urgent situations, for example, when we need to prevent a violation or respond to legal requirements. If you do not agree to the new terms, delete your Content and stop using the Service.

Continuation of the Agreement

Even if you stop using the Service, the provisions of the sections “Other Legal Terms” and “About this Agreement” will not cease to apply to you. In addition, subject to the terms of the “License Term” clause, in some cases licenses received from you will also remain in force.

Exception of provisions

If it turns out that any particular term of the Agreement cannot be enforced, all other provisions will not be affected and will remain in effect.

Concession

OHI-S may assign part or all of this Agreement to a third party in the event of a sale of the Service.

No Waiver of Rights

If you violate these terms and we do not take immediate action, this should not be considered a formal waiver of rights and does not mean that we do not intend to assert our rights in the future, including taking certain actions.

Governing legislation

The Agreement and your relationship with OHI-S under the Agreement are governed by the laws of the UAE.

If, according to any mandatory law of your country, the dispute cannot be resolved under the current legislation of the UAE, you can refer the case to a local court and resolve the issue, guided by local law.
